Victim compensation is a government trust that is employed to compensate victims for an expense that resulted from violent crimes, sexual assault, homicide, and occasionally burglary excluding property loss.

Every state has a 9/11 VICTIM COMPENSATION FUND ATTORNEYS  who aids in the processing of the compensation program from the government.

Who is Qualified to Receive Victim Compensation Funds?

The person qualified for compensation is usually anyone who is a direct victim of a vicious crime. We have diverse laws varying from state to state, but nearly most of them only compensate individual victims who were physically injured by the crime. Some states also compensate victims which were affected indirectly such as undergoing trauma, but not physical harm during the acts of the crime.

The families of the affected victims may receive compensation for hospital bills, funeral expenses, counseling sittings, and loss of support. Families affected by other crimes such as sexual assault, child abuse, and domestic violence are compensated with counseling services.

Types of Expenses Covered by Victim Compensation Fund

Victim compensation only covers crime-related expenses which are not already covered by insurance.

Some of the shared costs that victim compensation will cover include the following:

  • Therapy, healing, and counseling
  • Health and dental expenditure related to the crime
  • Lost income reimbursement
  • Loss of provision for kids and other dependents
  • Funeral costs up to a stated amount

Different states vary on how much money can be compensated for any one case. The benefits of compensation on average upper limit are about $30,000. While some states will pay more and others often pay less than that. An experienced victim compensation fund attorney will be able to give you proper guidance and advice on the laws in your state, regarding receiving compensation.

Necessities for Receiving Victim Compensation Fund?

For an individual to be eligible to receive a crime victim compensation fund, the state usually requires the following requirements:

  1. The happenings of the crime must be reported to the authorities or police, rather as soon as possible
  2. Maximum cooperation with the law enforcement as well as the prosecutors on the case
  3. Defer the compensation application before the given deadline. The state might be lenient on the schedule depending on the case.
  4. The individual seeking to be compensated must not have committed a crime nor have been in any involvement in the offense that contributed to or caused the injury or death. Let’s say for example a shoplifter in a convenience store would not be eligible for a crime victims’ compensation if he was shot during the commission of the said crime.

In sexual violation cases, a medical examination should be conducted within 72 hours with evidence collection.If the victim was injured or lost his or her life as a result of the crime.

In some circumstances, the victim who is receiving reimbursement may be required to make available testimonials, and physical evidence and assist in the identification of suspects.
